Upon arrival, Swoyer discovered 59-year-old Deshun Washington passed out in the driver's seat, a handgun in plain sight on the front passenger's seat, in what can only be described as a careless oversight. Washington was swiftly removed from the vehicle, prompting a further search by officers. They quickly seized a loaded polymer P80 as well as a loaded Mack 10 submachine gun, both positioned on the front passenger's seat beside Washington.

A records check revealed that the Mack 10 had been stolen out of New Mexico, elevating the gravity of the case. Following the discovery, Washington found himself under arrest and subsequently booked on several weapons charges.
